exculpation

Articial Building Intelligence with iTWO fm

In jurisprudence, exculpation (from the Latin culpa, "guilt") means the release of a person from guilt. In Facility Management This term is often used in connection with the Operator responsibility used.

Operational responsibility can be delegated in such a way that the operator's responsibility is at least partially transferred to the recipient of the delegation, i.e. the delegator can exculpate himself in the event of damage occurring.
Strict conditions are attached to effective delegation, otherwise the operator responsibility remains with the delegator. This applies not only to delegation to third parties, but also to internal delegation within a company. Against this background, delegation must be systematically organised and monitored - also in terms of contractual law.
